Oregon Man Sentenced After His Brother Escaped Kidnapping and Was Mistakenly Shot by Police
A North Albany man living at his parents’ home after returning from prison, John Dakota Lyon, was sentenced to 77 months after kidnapping his brother, Maverick Lyon, who was home on a college break, before forcing Maverick to face police, who shot him.
Prison Term for North Albany Man Who Put Brother in Line of Police Fire During Kidnapping
Dakota had been sentenced to 58 months in prison on convictions including First Degree Attempted Assault in the First Degree and Unlawful Use of a Weapon in February 2023.
After being released, he was living at home. His brother, Maverick Lyon, was home visiting his parents during winter break from college.
Dakota accused Maverick of conspiring with their father to harm Dakota and armed himself with a large kitchen knife and pulled Maverick throughout the house.
Maverick eventually convinced Dakota to allow him to grab his own kitchen knife, pretending they would leave the residence to confront their father together.
The father saw and heard what was happening through the home’s surveillance system and called 911 to report the crime.
Albany Police Department officers responding saw two men through the back door window and could see that one of them had a knife.
After a brief conversation between officers and the men, Maverick, still holding a knife, broke free of Dakota and rushed out the back door.
Maverick began dropping the knife, but officers standing at the door, fearing for their own and other officers’ lives, fired their weapons at Maverick.
Maverick was struck several times. Officers rendered first aid. While being treated, Maverick said, “You shot the wrong guy.”

Dakota was taken into custody without further incident. Methamphetamine may have played a role in the actions of Dakota, as a urine sample taken from him that day tested positive for the substance.
Dakota pleaded guilty to Attempted Kidnapping in the Second Degree, Unlawful Use of a Weapon, and Coercion on Thursday and was sentenced to a total of 77 months in prison and 2 years of post-prison supervision.
After undergoing surgery and a lengthy recovery period, Maverick appears to be doing well.
