Oregon Judge Who Blocked Trump’s Portland Troop Plan Sets Emergency Hearing Today

The Oregon federal Judge who granted an order earlier this month restraining the Trump Administration from deploying National Guard members to Portland from any state scheduled an 11 a.m. phone conference for Wednesday.

The judge invited legal argument on whether the temporary restraining order (TRO) should be extended for another two weeks.

U.S. District Judge Karin J. Immergut’s ruling to stop Trump’s multi-state National Guard push on October 5, when a TRO was granted, was valid for 14 days.

The ruling was appealed in the Ninth Circuit Court, where the court kept the Oregon National Guard federalized but temporarily blocked Trump from deploying troops.

In her ruling, Judge Immergut said, “This is a nation of Constitutional law, not martial law.”

The parties are awaiting a ruling from the appeals court on whether it will grant the Trump administration’s request to put a hold on Immergut’s order pending their appeal, but the 14 days provided in the TRO will soon lapse.

The stay granted by the three-judge panel of the 9th Circuit put a temporary administrative hold on Immergut’s restraining order, but confirmed that the Trump Administration cannot deploy troops to Portland while the panel deliberates on the case.

In the interim, lawyers have raised several disputes in a court filing this week regarding whether Judge Immergut has the authority to set further hearings if the appeals court grants the Trump administration’s request to pause her temporary order. These are expected to be under discussion during today’s call.
