Court Keeps Oregon National Guard Federalized but Blocks Trump From Deploying Troops
The Ninth Circuit federal appeals court temporarily gave the federal government control over Oregon National Guard troops on Wednesday, but affirmed the block on their deployment inside the state.

After the Oregon Governor sent National Guard Troops home, a three-judge panel in the federal appeals court handed down a decision to maintain Trump’s control over the Oregon National Guard but blocked their deployment until the panel can rule more broadly on the Trump administration’s request to overrule a district judge’s order that blocks the Guard’s deployment in Portland after Trump’s first attempt to seize control of the Oregon National Guard.
In a post on X, Oregon AG Rayfield confirmed that “The Ninth Circuit just granted an administrative stay preserving the status quo: The Oregon National Guard remains federalized but the President cannot deploy them.”
The decision follows a multi-state push to prevent Trump from deploying the National Guard, which resulted in a federal judge ordering that Trump can’t deploy the National Guard from any state.
The 9th Circuit Court confirmed that the administrative stay is intended to “minimize harm while an appellate court deliberates” and does not reflect a decision on the merits of the motion for a stay pending appeal.
Governor Kotek confirmed that the facts on the ground have not changed, and yesterday’s order prevents the Trump Administration from intervening militarily in Portland. AG Rayfiled also confirms that the leaders’ goal is to keep Portland peaceful and safe while their fight in the court moves forward.
Title 10, as invoked by the Trump administration, remains in force, but today, oral arguments will be heard by the Ninth Circuit Court.
In the meantime, the Washington State Attorney General’s Office announced that a coalition of 24 attorneys general and governors submitted an amicus brief in support of Oregon’s lawsuit to block Trump from deploying National Guard troops in Portland yesterday evening.
