This includes both legislation and presidential executive orders and/or signing statements.
I have recently been made aware of recent affirmations of states' rights by several states based on the Ninth and 10th Amendments. States such as New Hampshire, Washington, Arizona, Michigan, Missouri, Oklahoma, Montana, California and Georgia have all introduced bills or resolutions declaring sovereignty under the 10th Amendment. These resolutions and bills declare any federal laws or regulations that violate constitutional law to be null and void in that state, as they are beyond the scope and power of constitutionally delegated federal powers.
I am an Oregon native of 65 years and have been dismayed many times over by the legislative direction and political perspectives Oregon has taken in recent years. This appears to be due to four areas: Portland, Salem, Eugene and Ashland, all cities with larger proportions of non-natives. The rest of the state is predominantly conservative, including many Libertarians such as myself, who stand for liberty and individual rights, as guaranteed by the constitution.
It is already clear that the current administration is not for "change" but will tread the same disastrous path as the previous administration.
Therefore, it is up to us to do something about it.
All legislators and, in reality, all citizens need to read the U.S. Constitution with particular attention to the Ninth and 10th Amendments.
Next, refer to Texas bill HCR 50. It's time to claim states' rights and pass laws or resolutions claiming the same. Blatant constitutional violations include undeclared wars, illegal formation of the Federal Reserve and IRS, Patriot Acts I and II, House Bill HR45 that violates the Second Amendment, Senate Bill S1959, the Homegrown Terrorism Prevention Act, removal of habeas corpus, violations of Posse Comitatus, Fourth Amendment violations such as phone and cyber spying on citizens and a whole host of presidential executive orders from the Clinton and Bush administrations. All of these must be removed or declared null and void in the state of Oregon under the 10th Amendment.
This nation is a republic, not a democracy. Nowhere in the Declaration of Independence or Constitution is the word democracy. By law we are a republic and demand representative government. It's time the our legislators listen to their constituency and act accordingly ... NOW!
